Notice of Intent to Request a Release of Funds

On or about May 1, 2019 the Charter of Wayne County will request the U.S. Department of Housing and Urban Development (HUD) to release federal funds under Title I of the Housing & Community Development Act of 1974 (PL 93.383), as amended, for the following project:

Coogan Terrace Apartments in Melvindale, Wayne County, Michigan

From the FY 2018 HOME Funding Costs – $500,000.00

These funds will be for residential use.

Public Comment on Finding

All interested agencies, groups and persons disagreeing with this decision are invited to submit written comments for consideration. Such written comments should be received at the County’s address listed above on or before April 19, 2019. All such comments so received will be considered and the County will not request the release of Federal funds or take administrative action on the within project prior to the date specified in the preceding sentence.

Release of Funds

The County of Wayne will undertake the project described above with HOME Grant funds from the U.S. Department of Housing & Urban Development (HUD) under Title I of the Housing & Urban Development Act of 1974. The County of Wayne is certifying to HUD that the County of Wayne and Executive Warren C. Evans, in his capacity as County Executive, consent to accept the jurisdiction of the federal courts if an action is brought to enforce responsibilities in relation to environmental reviews, decision making, and action and that these responsibilities have been satisfied. The legal effect of the certification is that upon its approval, the County of Wayne may use the HOME Grant funds, and HUD will have satisfied its responsibilities under the National Environmental Policy Act of 1969.

Objections to County and HUD Release of Funds

HUD, Detroit Area Office will accept objections to its release of funds and the County of Wayne’s certification received for a period of fifteen days from its receipt of the request (whichever is later) only if they are on one of the following basis: (a) the certification was not executed by the Certifying Officer of the County of Wayne (b) the County of Wayne has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to HUD, Detroit Area Office, Patrick V. McNamara Building, 477 Michigan Avenue, Detroit, MI 48226. Potential objectors should contact HUD, Detroit Area Office to verify the actual last day of the objection period.
